Adult entertainment ordinance passed
The Le Mars city council this week approved the second reading of a proposed ordinance regarding adult entertainment businesses.
They also waived the third reading and adopted the ordinance. Copies of the ordinance are available for public review at city hall and the Le Mars Public Library. Council members and city staff said no public comment was received about the proposed ordinance after the last city council meeting.
DQ City staff and the city attorney drafted, discussed and reviewed the proposed ordinance which is in response to a phone call to the city inquiring about restrictions for adult entertainment businesses in Le Mars.
Mayor Virgil Van Beek earlier this month said city staff and officials decided to propose an ordinance since one has never been in place in Le Mars.
The ordinance is a compilation of bits and pieces of several existing similar ordinances in other Iowa communities.
Purpose of the proposed ordinance is "to regulate sexually oriented businesses and related activities to promote the health, safety, morals and general welfare" of Le Mars citizens and "to establish reasonable and uniform regulations to prevent the deleterious location of adult cabaret businesses within the city."
An adult cabaret is defined in the ordinance as a commercial establishment that regularly features persons who appear in a state of nudity or live performances that are characterized by the exposure of specified anatomical areas or by specified sexual activities or erotic dancing.
Among requirements included in the ordinance are that adult cabaret business would be permitted only as a conditional use in any B-3 zoned commercial district provided that, among other things, the business could be not be operated within 1,200 feet of a church, school or day care center, boundary of any residential district, public park, governmental offices or in any residential area.
The ordinance also addresses standards of conduct and operation, permits and fees, exterior portions of sexually oriented businesses, signage, prohibition of persons younger than 18 and consumption of alcohol.
